Why would a USA business out of Pompano Beach, FL. duplicate the business names of the real Canadian Essiac company and even take it one step further and blatantly copycat the Canadian Essiac labels if they really owned the genuine Essiac formula.? Why would anyone mislead the consumer this way.?

Just because a business owns a USA trademark #1,625,600 for the word "essiac" does not mean they own the genuine Essiac formula researched and clinically tested by Nurse Rene Caisse.
Registrant: of the above copycat label is Essiac International, also known as Essiac Products Services Inc, Essiac Inc., eessiac, and Resperincanada all of Pompano Beach, FL. USA.
This Pompano Beach business misleads the consumer into thinking that they manufacture the original Essiac formula only because the Pompano Beach business usurped and registered the USA trademark name of "essiac" for themselves.
The various web sites registered to the Pompano Beach business will retail their so called "USA essiac" for $10.00 on one web site and then on a completely different web site retail the same "USA essiac"as their "BEST PRICES AVAILABLE" for $39.95. Too really confuse the consumer, the Pompano Beach business also retails a liquid essiac under the domain of eessiac.com.
The Canadian business that legally owns the original Essiac formula, Essiac Canada International and Essiac Products Inc. of Canada are NOT affiliated with the Pompano Beach business listed under the various names of Essiac International, Essiac Products Services Inc., Essiac Inc, Resperincanada, Easy-ac, essiac-usa, and eessiac.com all of the USA.
The Pompano Beach business even claims that their product is the same Essiac formula registered with the Canadian Government Ministry of Health.
#1. There is no Canadian Government "Ministry of Health."
#2. Rene Caisse never divulged her Essiac formula to the medical establishment or registered her formula with the Canadian Government for fear the formula would be either tampered with or withheld from the public.
#3. In 1977 when Rene Caisse legally signed over the Essiac formula to David Fingard, president of Resperin Corporation of Toronto, she signed a legal document confirming the formula was always held secret and that she never disclosed the Essiac formula to anyone. Note the misuse of the advertising claim of "from Resperin Corporation, Inc." on the above label.
On May 29, 1995 Essiac Products Inc. of Canada legally purchased the Essiac formula and rights from Resperin Corporation of Toronto. The business entity, Resperin, legally dissolved October 2, 1998 after the death of company president David Fingard who purchased the legal formula from Rene Caisse in 1977.
Today, Rene Caisse's original Essiac formula is legally owned only by
T. P. Maloney of Essiac Canada International by way of purchasing the company Essiac Products Inc. in the Spring of 2002.
There is only one authentic Essiac formula, blended in the proper ratios with government inspected herbicide and pesticide free grown herbs, harvested only at their peak of synergistic potency.
One herb used in the Essiac formula must be harvested every four years - not before it's time.
Clearing up the false claims and scare tactics
#1. A subsidiary of the Pompano Beach business (eessiac.com) retails a liquid essiac with a bright red label on the bottle, which really confuses the consumer even more by making claims of "If you buy Essiac® as a powder then it is NOT real Essiac®." This is a complete advertising contradiction since they do sell their powdered concoction with the copycat label as shown above but on a different web site. This is also a "herbal" contradiction as Essiac starts off as a living plant, dried and is then ground up into a powder.
#2. In addition, these USA business' will try to scare the USA public into thinking that if they import Essiac from Canada their parcels will be confiscated by USA customs, and that Americans "are either committing a crime OR purchasing a counterfeit product, and is even fraudulent" This is false information and is only a scare tactic.
The FDA Alert 66-64 pertains to a former incident of a Canadian business making false medical claims. This company behaved irresponsibly and the FDA through US-Canadian International agreements with Health Protection Board (HPB) of Canada rightfully took legal action against this business and closed it down. This is why authorized Essiac distributors have legal disclaimers on their web sites to conform to FDA and HPB legal advertising claims.
Only authorized Essiac distributors for Essiac Canada International are provided with Essiac Canada International's FDA business registration number and USA FDA import codes. This is in compliance with the December 13th 2003 USA FDA Bioterrorism Act.
